1. THE PARTIES
1.1 The Seller

Represented by the General Manager.
The Horizane Santé Online Store is the official online store for Horizane Santé products (Vitalens, Hydrolarm, Precitech, Mainclean, Nature & Senteurs, Horizane optic, Plic, Eclawhite, Fruitamines, Magic Eyes) in France.
The Horizane Santé Online Store is hosted by HOSTINGER INTERNATIONAL LTD, whose registered office is at 61 Lordou Vironos Street, 6023 Larnaca, Cyprus, which can be reached via the following means: https://www.hostinger.fr/contact
1.2 The Client
The General Conditions of Sale apply only to orders for Products placed on the horizane.com Online Store by natural persons of legal age who have the capacity to enter into a contract and meet the definition of consumer, within the meaning of the Consumer Code (hereinafter the “Customer”).
The Client declares that he/she is of legal age and has full legal capacity to enter into these general terms and conditions and thus enter into contracts under French law.
2. CONDITIONS OF APPLICATION OF THESE CONDITIONS
These general conditions of sale apply without restriction or reservation to all sales of Horizane Santé Products (the “Products”) offered on the horizane.com Online Store.
Any order placed on the website https://horizane.com implies prior consultation and acceptance of these general conditions.
The Customer acknowledges having read the General Conditions of Sale at the time of placing the order and at the latest at the time of validation of the order.
2.1 Customer Service
For any questions or complaints relating to an order placed on the horizane.com Online Store, the Customer can contact Customer Service (hereinafter “Customer Service”):

3. SCOPE OF THIS AGREEMENT
The General Conditions of Sale are supplemented by the Privacy Policy of the Horizane Santé Online Store
The General Terms and Conditions of Sale may be modified at any time. It is important to note that the applicable version is the one in effect at the time the Customer confirms their order, which is constituted by the payment of the order.
4. PRODUCT INFORMATION
The Features
In accordance with Article L.111-1 of the Consumer Code, the Customer may, prior to placing an order, learn about the main characteristics of the Products offered for sale either on the Company's website or by requesting information using the contact form.
When browsing the Online Store, the Customer can access the description of each Product (including the name of the Product, its reference, its price, its color, its composition). The main characteristics of the Products added to the basket are also recalled on the “Your basket” page.
Horizane reserves the right to modify its collections and to change the list and range of products at any time. The product photos presented on the website and in the catalogs are updated regularly but are not contractually binding.
The costs
Product prices on the website are in euros (€) including all taxes, excluding delivery charges. Delivery charges depend on the order amount, weight, and the country of delivery.
The products
The items available for sale are those present on the Site. They are offered within the limits of availability displayed on the Site. The Company reserves the right to withdraw from sale any item present on the Site or to modify any information associated with the items appearing on the Site.
The greatest care is taken in the presentation of the products as well as their description. The photographs and descriptions provide the most accurate image possible, but it is nevertheless possible that non-substantial errors may appear on the site, which the Customer acknowledges and accepts.
In any event, the non-conformity of the delivered item in relation to its description on the site entitles the Customer to implement the Company's conformity guarantee, whose liability is limited to the reimbursement of the item, delivery costs and reasonable costs of returning the item displayed by the Customer.
The customer agrees to use the products in accordance with their intended purpose and to follow the instructions for use of the products for their intended purpose. Horizane Santé cannot be held responsible for the misuse of the products, in particular use for purposes other than those intended.
Availability
Only product offers at the prices presented on the site are valid while stocks last. Horizane makes every effort to ensure maximum product availability for customers.
For technical reasons specific to distance selling, it may happen that the Products chosen by the Customer are no longer available when the Seller confirms the order. In this case, the order will be cancelled and the Customer will be automatically reimbursed for the price of the Product concerned, as well as any delivery costs.
5. ORDERING PROCESS
5.1 Order taking Order taking includes the following steps:
- step 1: Select a product and add it to your basket.
- step 2: The Customer must complete their information (last name, first name, delivery address, etc.) when opening their Customer account or when placing each order. This information must be complete, accurate, and up-to-date. The Customer is responsible for the accuracy and completeness of the information in their Customer account and their order to ensure it is processed correctly. Therefore, any costs incurred by HORIZANE SANTÉ resulting from errors in the information provided by the Customer will be borne by the Customer, in particular the costs of reshipping the order.

- step 5: Choose the delivery methods for your order, after having read the delivery times and prices for each of the delivery methods offered, indicated on the page;
- step 4: Acceptance of all the general terms and conditions of sale by checking the box “I accept the general terms and conditions of sale” (box unchecked by default)
- step 7: Select the chosen payment method and payment.

Any order placed by the Customer via the aforementioned steps constitutes irrevocable acceptance of the general conditions.
5.2 Confirmation of the order
An on-screen and email confirmation will be sent to the customer to validate the order, provided that the email address provided in the registration form does not contain any errors. Final validation of the order will only take place after validation and acceptance of payment.
The confirmation email will include the following information:
- The products and quantities purchased;
- The means of transport chosen;
- identification of the order number;
- the total amount of the order (price, shipping costs, VAT, discounts, etc.);
- A link allowing the Customer to access the complete details of their order;
It is the Client's responsibility to keep the contractual information on the medium of their choice.
5.3 Modification and cancellation of the order
The Seller reserves the right not to confirm the order, particularly in the event of payment authorization refusal, incorrect address, or any other problem with the user's account. In this case, the Seller will inform the Customer by email.
The Customer may cancel their order as long as it has not been shipped. Once the order has been shipped, cancellation will no longer be possible, and the Customer may exercise their right of withdrawal upon receipt of the product. The Seller reserves the right to refuse excessive orders from the Customer.
5.4 Availability of Products
The Seller makes every effort to ensure that the Products offered on the Horizane Santé Online Store and ordered by the Customer can be delivered. For technical reasons specific to distance selling, however, it may happen that the Products chosen by the Customer are no longer available when the Seller confirms the order.
In this case, the order will be cancelled and the Customer will be automatically refunded the amount of the price of the Product concerned, as well as the delivery costs if the order did not contain any other Products. If only part of the Products ordered by the Customer is unavailable, the other Products will be delivered to him and the Customer will be refunded the amount of the missing Product(s) not delivered.
6. PAYMENT
6.1 Price of Products
The price is mentioned on the Product Page of the Online Store as well as in the “Shopping Cart” and the “Order Summary”. The price of each Product is indicated in euros and includes all taxes (TTC). The price of the Product does not include any delivery costs, which are indicated to the Customer when ordering during the order validation process and before the Customer confirms it.
The Seller reserves the right to modify its prices at any time but the products will be invoiced on the basis of the rates in effect at the time the order is recorded, subject to availability.
6.2 Obligation to pay for the order
The Customer is informed and acknowledges that by placing an order on the Seller's Online Store, he/she undertakes to pay the Seller the full amount of the order at the time of validation of the order and declares that he/she has the capacity and means necessary to honor it.
6.3 Accepted payment methods
All orders are payable in EUROS. To pay for their order, the buyer has all the payment methods listed on the order form: credit card and PayPal.
Payment for the entire order must be made by the buyer at the time of ordering. At no time may the amounts paid be considered as a deposit or down payment.
For credit card payments made on its website, the Seller uses the secure payment service of its partner bank's server. All information transmitted from the website https://horizane.com to the payment system is systematically encrypted to ensure its confidentiality. All credit card payments made on the website are debited immediately.
6.4 Securing transactions
Payments on this website are made by credit card through a secure payment system. This website secures your confidential information with an SSL certificate. The information exchanged is encrypted with SSL (Secure Socket Layer) before being transmitted. Since this information is illegible, no one can use it without your knowledge.
Horizane Santé reserves the right to suspend or cancel any order and/or delivery in the event of non-payment by the Customer, payment incident and/or fraud in the use of the site or the payment method chosen by the Customer.
Horizane Santé uses the 3D Secure system. 3D Secure is a system designed to secure online payments.
And which allows, before the request for electronic payment authorization, to connect the Customer with their bank so that the latter can authenticate its cardholder. The authentication method is left to the cardholder's bank to choose.
The Seller's payment system offers a range of controls to optimize payment security, such as - for example - identifying the country of origin of a card and identifying the Customer's IP address.
6.5 Retention of title
The delivered product remains the property of the Seller until full and effective payment of the price by the Customer. Failure to pay may result in the Seller claiming the product.
The transfer of risks of loss or deterioration to the Customer takes place on the date of delivery of the product, i.e. receipt of the product by the Customer.
7. DELIVERY OF THE ORDER
7.1 Place of delivery
Products ordered from the HORIZANE SANTÉ Online Store can be delivered to mainland France, including Corsica, and Europe.
7.2 Delivery costs and times
When ordering, the Customer can choose between different delivery methods. The default delivery method is standard delivery. Delivery costs, delivery times, and the carrier depend on the delivery method chosen by the Customer:
1. Standard Delivery: Delivery time is 2-5 business days from shipment confirmation;
2. Delivery to a relay point: the delivery time is 2 to 5 working days from confirmation of shipment.
3. Delivery to Store: delivery time is 1 hour on a working day from order confirmation.
The products ordered by the Customer will be delivered within a maximum of 30 days from the order confirmation and payment.
In the event of unavailability of the product, the Seller undertakes to inform the Customer as soon as possible so that the Customer can be reimbursed without delay and at the latest within 14 days of payment of the sums paid.
7.3 Delivery tracking
The Customer receives an email to confirm the shipment of the order and provide the tracking link that will allow them to locate the package.
7.4 Delay in delivery
In the event of a delivery delay (delivery exceeding 30 days), the Customer may request the Seller to make the delivery within a reasonable additional period. If the Seller has not complied within this period, the Customer has the right to cancel their order, unless the Seller has complied in the meantime or if the delivery delay is the result of a case of force majeure. Emails will be sent to store@horizane.com.
The Seller cannot be held liable for the consequences of any events beyond its control, in particular cases of force majeure or unforeseeable circumstances, which may tend to delay or prevent delivery of the product ordered.
In the event of a foreseeable extension of the delivery time, the Seller undertakes to inform the Customer as soon as possible and by any means so that the latter can then choose to maintain or cancel all or part of his order.
When the delivery time constitutes an essential condition of the sales contract for the Customer, the Customer may immediately terminate the contract in accordance with the above terms, without requiring the Seller to make delivery within a reasonable additional period. The decisive nature of the delivery time may result from the circumstances expressly surrounding the conclusion of the contract. If delivery occurs in the meantime, the order must be returned in its entirety to the Seller and the Customer will be reimbursed for the amount of the order and the return costs in accordance with the reimbursement terms set out in these General Terms and Conditions of Sale.
7.5 Cancellation of the order
. Cancellation of the order can be done by:

- telephone on + 33 (0)4 42 90 52 10 (price of a local call in France) from Monday to Friday from 9:00 a.m. to 6:00 p.m.
When the order is cancelled, the Seller will reimburse the Customer for all sums paid, at the latest within fourteen days following the date on which the contract was terminated.
If delivery occurs in the meantime, the order must be returned in its entirety to the Seller and the Customer will be reimbursed for the amount of the order and the return costs according to the reimbursement terms set out in these General Conditions of Sale.
7.6 Delivery difficulties
According to Article 1193 of the Civil Code, a contract (including an online sale) is irrevocable, unless one of the parties fails to fulfill its obligations.
According to Article 1231-1 of the Civil Code, a party who suffers damage due to a fault of the other party may claim compensation for the damage suffered.
If delivery is made impossible due to an error in the address provided by the Customer, the delivery costs will not be refunded and a new shipment may be offered at the Customer's expense. If the error is attributable to the Seller or its carrier, the order will be reshipped at no additional cost to the Customer or, if this is impossible, fully refunded, including delivery costs.
In the event of force majeure making it impossible to execute the order, the Seller will inform the Customer as soon as possible. If the impediment persists beyond a reasonable period, the Customer may cancel their order and will be reimbursed within 14 days for the amounts paid, including delivery costs.
7.7 Compliance of the order and reservations
If the Products received by the Customer do not correspond to those ordered or in the event of an incomplete or damaged order received during transport, it is the Customer's responsibility to express reservations and contact the Seller's Customer Service. The Customer must report any difficulties encountered within 48 hours of receiving the products. If reservations are not expressed within the aforementioned 48-hour period, the delivery will be deemed to be compliant.
7.8 Transfer of risks
The risks of loss and damage to the ordered Products are transferred to the Customer upon physical receipt of the package. If delivery is made impossible due to force majeure, the Customer may cancel their order and will be reimbursed within 14 days for the amounts paid.
7.9 Non-collection of packages and delivery costs
In accordance with Article L. 216-1 of the French Consumer Code, delivery is deemed to have been made when the consumer takes physical possession of the goods or when they are made available according to the terms and conditions specified when ordering. If the customer does not collect their package within the time limits set by the carrier and it is returned to us, the seller cannot be held responsible for non-delivery.
In this case, the customer can choose:
A new shipment of the package, the reshipping costs being at the customer's expense.
A refund of the amount of the order, excluding initial delivery costs, which cover a service already provided in accordance with the seller's obligations.
The refund will be made within 14 days of receipt of the returned package, and the customer will be informed by email of the processing of their request.
8. RIGHT OF WITHDRAWAL
8.1 Terms and time limit
Pursuant to Article L 221-18 et seq. of the French Consumer Code, the Customer has a withdrawal period of thirty days from the date of receipt of the order by him or by any third party designated by him. To inform the Seller – by email at store@horizane.com. of his wish to exercise his right of withdrawal.
In order to process the return correctly, the customer is asked to indicate on the copy of the invoice and the withdrawal form as attached to these General Conditions of Sale.
To exercise his right of withdrawal, the Customer must:
Within 15 days of receipt of the Product, inform the Seller of your decision to withdraw by sending the withdrawal form to the Seller, by email to the following address: store@horizane.com.
No later than 7 days following notification of the decision to withdraw, the Customer must return the Products concerned, in perfect condition and in their original packaging. Failing this, the Seller reserves the right to refuse the return of the Products.
To return the Products, the Customer must follow the steps below:
1. Complete the return form as attached to these General Conditions of Sale
2. Send an email to the following address: store@horizane.com attaching the return form and confirming the right of withdrawal.
3. Store the product(s) to be returned in the original packaging.
4. Include the return form and a copy of the invoice in the package
5. Go to the carrier of your choice to return the package to the following address, the return costs being borne by the Customer: Horizane Santé Pôle d'Activité 205 rue Louis Berton 13290 Aix en Provence. France
Return shipping costs are the responsibility of the Customer, unless the product is defective or non-compliant. The Customer may try the product under normal in-store conditions. In the event of product depreciation due to excessive handling, a partial refund may be issued.
The Customer bears all risks of this shipment. The Seller will not be liable for any loss, theft, or delay of the returned product. The burden of proof of return rests with the Customer.
Therefore, the Seller undertakes to reimburse the Customer within a maximum period of 14 days from the earliest event between the actual return of the product and the sending by the Customer of proof of shipment of the product, directly to the payment method used.
Any order returned without having been notified by the withdrawal form will not be processed.
8.2 Reimbursement
The refund of the price of the returned Products will be made according to the payment methods chosen when ordering.
The refund will be made as soon as possible after the Seller has acknowledged the return of the Products, giving rise to the sending of an email confirming receipt of the returned products to the Customer.
9. LEGAL GUARANTEES
The Customer has the following legal guarantees for any Product purchased from the Seller's Online Store:
9.1 Guarantees of Conformity
Article L217-4: The seller is required to deliver goods that conform to the contract and is liable for any lack of conformity that exists at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when this has been his responsibility under the contract or has been carried out under his responsibility.
Article L217-5: To comply with the contract, the property must:
1° - Be suitable for the use usually expected of a similar good and, where applicable:
- Present the qualities that a buyer can legitimately expect in view of the public statements made by the Seller, in particular in advertising or labeling;
2° Or present the characteristics defined by mutual agreement by the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.
Article L217-12: The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods.
In the event of a lack of conformity of the Product upon delivery, the Customer may request a replacement of the Product. If replacement of the Product is not possible, the Customer may be reimbursed the value of the purchase price of the Product.
In order to facilitate the implementation of these guarantees, the Customer must keep the invoice for the Product.
Any defect, breakage, deterioration of the Product resulting from incorrect use of the Products by the Customer may not give rise to activation of any of the legal or commercial guarantees.
9.2 Guarantees against hidden defects.
Article 1641: The seller is bound by the guarantee for hidden defects in the thing sold which make it unfit for the use for which it is intended, or which reduce this use so much that the buyer would not have acquired it, or would have paid a lower price for it, if he had known of them.
Article 1648: The action resulting from latent defects must be brought by the Client within two years of the discovery of the defect.
10. INTELLECTUAL PROPERTY
The Seller remains the exclusive owner or licensee of all intellectual and industrial property rights to the products and this website. The purchase of a Product does not grant the customer any rights to the products, their representations, or the designation of the products. Any use, in any manner whatsoever, by the customer of any of the elements referred to above is strictly prohibited.
Any reproduction, representation, use, total or partial modification of these elements is prohibited.
11. PERSONAL DATA
As part of order processing, the Seller is required to collect and process the personal data of the Customer as well as that of the recipient of the order. The Seller respects the confidentiality of this data and undertakes to comply with the Data Protection Act of 6 January 1978 when processing it. The Customer is informed that his or her data may be used by the Seller or a third party designated by him or her to process his or her order, inform him or her of new products and promotional offers, competitions, etc. In accordance with the Data Protection Act of 6 January 1978, the Customer has the right to access, oppose, rectify and delete data concerning him or her by contacting the Seller's customer service at the following address: contact@horizane.com
12. COMMUNICATION BY ELECTRONIC MEANS
By using our online sales service, the Customer expressly and unreservedly accepts that all declarations, notices, information and other communications relating to the Products are transmitted electronically, except where mandatory legal provisions require the use of non-electronic writing exclusively.
In the event of a dispute, the documents stored in the Seller's computer databases shall constitute proof
13. MISCELLANEOUS
13.1 Independence of clauses
If one or more provisions of these General Conditions of Sale prove to be invalid, illegal or inapplicable, for any reason whatsoever, the validity of the other provisions of the General Conditions of Sale will not be affected and the other provisions will remain in force.
The fact that either party does not claim the application of any clause of the General Conditions of Sale or acquiesces to its non-performance, whether permanently or temporarily, cannot be interpreted as a waiver by that party of the rights arising for it from said clause.
13.2 Dispute Resolution
Pursuant to Article L.612-1 of the French Consumer Code, disputes falling within the scope of disputes are exclusively those defined in Article L.611-1 of the French Consumer Code, namely disputes of a contractual nature, relating to the execution of a sales contract or the provision of services, between a consumer and a professional. The text covers national disputes and cross-border disputes.
In the event of a dispute relating to the formation, conclusion, validation, interpretation, execution, termination or consequences of the termination of the General Conditions of Sale, the Customer shall contact the Seller as a priority in order to find an amicable solution. To do this, the Customer is invited to first contact Customer Service by email at contact@horizane.fr;
Only complaints relating to the online sale of Products on the Seller's Online Store will be taken into account.
13.3 European Disputes
Any dispute that cannot be resolved amicably may be the subject of a complaint on the Dispute Resolution Platform set up by the European Commission accessible at the following address https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.show&lng=FR, The Client may, at his own expense, seek assistance from counsel.
13.4 Language and applicable law
The General Conditions of Sale and sales made on the Seller's Online Store are governed by French law and in the French language.
14.5 Modification of the General Conditions of Sale
The General Terms and Conditions of Sale are subject to modification at any time by the Seller. The applicable version is the one in effect at the time the Customer confirms the order, which is constituted by the Customer's payment of the order.
The Seller reserves the right to apply specific limits of these Clauses to promotional offers: sales, group offers, Products offered, sales with gratuity, various discounts and free deliveries.
The Customer is invited to save and print these general terms and conditions of sale, which are binding between the parties.
